On July 28, the Spanish Data Protection Authority (AEPD) issued updated guidance on the use of cookies based on the new guidelines from the European Data Protection Board (EDPB). The AEPD cookie consent guidance provides companies doing business in Spain with more clarity on how to lawfully obtain consent for tracking technologies with a user interface, such as a banner and a preference center. Enforcement of the updated guidelines commences on October 31.

- Cookie walls are not permitted as they do not offer a valid alternative to consent
- Continued browsing without interacting with a cookie consent banner does not constitute valid consent
- Updated guidance must be implemented no later than October 31
