Employee vs. consumer rights: Same concept, different reality

On January 1, 2023 California’s new and improved privacy law – the CPRA – goes into effect and replaces the existing CCPA. This date also marks the end of a critical exemption from the original CCPA: the exemption of employee data from the scope of the law.

With the employee exemption ending, California employees benefit from the same privacy rights given to California consumers. And while this may seem like a straightforward extension of existing consumer rights processes for organizations, that is often not the case.
